RESOLUTION NO. 2008-R-02
COMPLIANCE MAINTENANCE RESOLUTION
RESOLVED the Village Board of Cleveland informs the Wisconsin Department of Natural Resources that the Village Board took the following actions.
1. Reviewed the Compliance Maintenance Annual Report which is attached to this resolution.
2. Set forth the following actions necessary to maintain effluent requirements contained in the WPDES Permit:
(a) To operate and maintain the wastewater treatment plant in compliance with WPDES Permit #WI 0030848-5.

RESOLUTION NO. 2008-R-03
JUNIPER STREET RECONSTRUCTION PROJECT
PRELIMINARY RESOLUTION DECLARING INTENT
TO LEVY SPECIAL ASSESSMENTS UNDER MUNICIPAL POLICE POWER
PURSUANT TO SEC. 66.0703, WIS. STATS.
RESOLVED, by the Village Board of the Village of Cleveland, Wisconsin:
1. The Village Board hereby declares its intention to exercise its police power under Sec. 66.0703, Wis. Stats., to levy special assessments upon property in the assessment district hereafter described for benefits conferred upon such property by reason of the following public work and improvements: sanitary sewer, water, storm sewer and street construction, to include the installation of curb and gutter.
2. The property to be assessed lies within the following described assessment district: All property fronting upon both sides of Juniper Street and W. Grant Avenue.
3. Before the improvements are made, the Village Board shall keep an accurate account of the expenses incurred in front of each lot and shall report these costs to the Village Clerk-Treasurer who shall cause the amount charged to each lot be entered on the tax roll as a special tax against the lot.
5. The Village Board determines that the improvements constitute an exercise of the police power for the health, safety and general welfare of the municipality and its inhabitants.
6. The Village Engineer has prepared a report consisting of:
a. Preliminary plans and specifications for the improvements.
b. An estimate of the entire cost of the proposed street and curb and gutter improvements.
c. Schedule of proposed assessments.
7. The Village Engineer has filed a copy of the report with the Village Clerk-Treasurer for public inspection.
8. The clerk shall cause notice to be given stating the nature of the proposed improvements, the general boundary lines of the proposed Assessment District, the time and place at which the report may be inspected, and the time and place of the public hearing on the matters contained in the preliminary resolution and the report. This notice shall be published as a class 1 notice under ch. 985, Stats., and a copy shall be mailed, at least 10 days before the hearing, to every interested party whose address is known or can be ascertained with reasonable diligence.
9. The hearing shall be held in the Cleveland Village Hall, 1150 W. Washington Avenue, Cleveland, at a time set by the Village Clerk-Treasurer in accordance with Sec. 66.0703, Wis. Stats.
10. The assessment against any parcel may be paid in cash or in five (5) annual installments if the total assessment is less than $5000 or in ten (10) annual installments if the total assessment is $5000 or greater.

ORDINANCE NO. 2008-O-02
AN ORDINANCE TO AMEND SEC. 10-1-34 HORSES AS CONDITIONAL USES
WHEREAS, the Code of Ordinances of the Village of Cleveland was in conflict regarding whether the keeping of horses in the A-1 Agricultural District required a conditional use permit; and
WHEREAS, the Plan Commission considered the keeping of horses on A-1 property to be of similar character to the keeping of cows, sheep, and other farm animals, none of which required a conditional use permit to raise; and
WHEREAS, the Plan Commission reviewed and recommended the Village Board amend the Code of Ordinances to clarify horses may be raised as permitted uses in the A-1 District; and
WHEREAS, the Village Board considered public comment on the proposal during a properly noticed public hearing.
NOW, THEREFORE, the Village Board of the Village of Cleveland do ordain as follows:
Section 1. Pursuant to Section 62.23, Wis. Stats., the Village of Cleveland does hereby amend Sec. 10‑1‑34 to read as follows:
SEC. 10-1-34 HORSES AS CONDITIONAL USES
In the discretion of the Plan Commission and Village Board, horses may be allowed as a conditional use within all zoning districts of the Village, provided the standards of Sec. 10-1-60 and Sec. 10-1-69 are followed and with the exception that horses shall be permitted uses in the A‑1 Agricultural District.
Section 2. This ordinance shall become effective upon posting as required by law.

ORDINANCE NO. 2008-O-03
FLOODPLAIN ZONING ORDINANCE
WHEREAS, the Village Board was notified the current version of the Floodplain Zoning Ordinance of the Village of Cleveland, Manitowoc County, Wisconsin, did not meet current state and federal standards; and
WHEREAS, the Plan Commission reviewed and recommended the Village Board repeal the existing ordinance and replace it with the legally-compliant ordinance it approved; and
WHEREAS, the Village Board accepted the recommendation of the Plan Commission and considered public comment during a properly noticed public hearing.
NOW, THEREFORE, the Village Board of the Village of Cleveland do ordain as follows:
Section 1. Pursuant to Section 62.23, Wis. Stats., and the requirements of Sec. 87.30, Wis. Stats., the Village Board of Cleveland does hereby repeal the Floodplain Zoning Ordinance of the Village of Cleveland, Manitowoc County, Wisconsin, and replace it with the attached Floodplain Ordinance for Cleveland, Wisconsin.
Section 2. This ordinance shall become effective upon posting as required by law.

MANITOWOC COUNTY, WISCONSIN
INSTALLMENT ASSESSMENT NOTICE
FOREST STREET PROJECT
Notice is hereby given that a contract has been let for public improvements consisting of streets, storm sewer, and utility infrastructure, and curb and gutter related to the Forest Street Project, and that the amount of the special assessment for the improvement has been determined as to each parcel of real estate affected and a statement of the assessment is on file with the Village Clerk-Treasurer. It is proposed to collect the special assessment in cash or in five (5) annual installments if the total assessment is less than $5000 or in ten (10) annual installments if the total assessment is $5000 or greater, as provided for by Sec. 66.0715, Wis. Stats., with interest at 5.75% per year. All assessments will be collected in installments except assessments on property where the owner files with the Village Clerk-Treasurer, within 30 days from date of this notice, a written notice that the owner elects to pay the special assessment on or before the following November 1, unless the election is revoked. If, after making the election, the property owner fails to make the payment to the Village Clerk-Treasurer, the entire assessment shall be placed on the following tax roll.
